Mediation fee schedule
Mediation fees are charged on the basis of a fixed fee per party for each day of the mediation and payable in advance. A typical mediation day usually begins at 9:30 a.m., ends around 5:30 p.m. and includes a working lunch. If a mediation takes more than one day, a second daily fee is charged, but second day mediations occur only when agreed upon by all parties at the conclusion of the first day of mediation (or unless expressly ordered by the Court). If the parties request in advance more than one successive day for mediation, the full fee for all scheduled sessions is due upon commencement of the first day of mediation.
The mediation fee is based upon (1) the amount in controversy, and (2) the number of parties. The amount includes the total of all claims (including counterclaims and attorney fees) but does not include court costs or exemplary damages. All parties represented by the same attorney are considered one party for the purposes of the mediation fee. If mediation lasts past 9:00 p.m., there will be an additional hourly charge of $350 per hour to be split among the parties.
Full Day Mediation:
Two Parties $1,150.00/per party
Three or More Parties $1,000.00/per party
Half-Day Mediation:
Per Party $550.00
HALF-DAY FEES (arranged in advance). Half-day mediation will be permitted for county or district court cases if the amount in controversy is under $100,000. Minimum $550 for four (4) hours per party. If mediation exceeds four (4) hours, each party will be charged an additional rate of $200 per hour. Half day mediation begins at either 9:30 a.m. or 1:30 p.m.
CANCELLATION POLICY. Late cancellation of mediations causes a variety of problems for all concerned. To minimize this problem, the following late cancellation policy will apply: If mediation is cancelled 36 hours prior to the scheduled mediation date, a cancellation fee of one-half the quoted mediation fee will be charged to the canceling party.
EXPENSES. Occasionally, it is necessary to incur certain expenses for large, multi-party complex cases. Examples include larger hearing rooms and/or additional caucus rooms. Such expenses will be disclosed in advance and agreed by the parties before the mediation.
The objective is to provide quality, efficient and affordable mediations. If the fee and/or policy are inappropriate to a particular case, Mr. Work is amenable to discussing alternatives. Fees must be paid in advance before mediation can begin. Checks should be made payable to WORK LAW FIRM and the applicable tax identification number is 20-4323836. Due to previous experience, no client personal checks will be accepted. Checks should be drawn against accounts of law firms, insurance companies or verifiable corporate or business accounts.
LOCATION. Mr. Work conducts most mediations in the Greenway Plaza area in two different locations depending on the convenience of the parties. Location should be confirmed prior to the mediation. Unless notified differently, mediation will be held either at the offices of the Bergman ADR Group or at Greenway Mediation Center.
REPORT. Prior to mediation, at least three business days, if possible, the parties should forward their mediation report to Mr. Work. Pleadings and any factual key evidentiary documentation should be included in the report.
